What is the difference between guardianship and conservatorship - Portland, Oregon.

March 25, 2010

Be aware that the terms are used differently in different states.

In Oregon:
•    A guardian is someone appointed by the court to make healthcare decisions for another person.
•    A conservator is someone appointed by the court to make financial decisions for another person.

In Washington state:
•    A guardian of the person makes healthcare decisions
•    A guardian of the estate makes financial decisions

In California:
•    A conservator of the person makes medical decisions
•    A conservator of the estate makes financial decisions

Using the Oregon terms:
•    For a guardianship, we have to prove to the court that a person is unable to care for his or her physical health.
•    For a conservatorship, we have to establish that a person is financially incapable.

These are two separate things. A person may be able to make decisions about his or her health, but not about money—and vice-versa.
