You can do that without disqualifying yourself for Medicaid—but you need to formalize that in a care contract. And that has to be done at the time that you enter into this agreement. You can’t say, “Well, my son’s been providing care for me for the past three years. So I am going to write him a check for $36,000 and that covers the last three years of care and it’s not a gift.” That doesn’t work. If you are going into an arrangement where an adult child is going to provide care for pay, the written agreement has to be in place from the beginning.
