Does the executor of an estate need a lawyer - Portland, Oregon.

August 13, 2010

There’s no legal requirement that you have a lawyer. There is also no legal requirement that you go to a mechanic to change the transmission in your car. The do-it-yourself process is possible, but not always advisable.

Practically speaking, if the estate is going to be probated, you pretty much need a lawyer.

If the estate is not going to be probated, then you may not need a lawyer.

There are other things like taxes to deal with, but you may not need a lawyer.

The problem is that you don’t always know what situation you’re in.

You can always meet with a lawyer for one appointment and then decide after that if you need further help.

The lawyer will look at the assets and liabilities and come up with a plan for paying the liabilities and paying the taxes and getting the assts into the names of the proper beneficiaries.

The idea is getting assets from Point A to Point B. There are different ways to do that, so the lawyer tells you how to accomplish that with the least amount of process and the least amount of taxes.
