In one kind of trust, the funds are a gift from someone—usually a parent or grandparent, although they can also come from an uncle, aunt, sibling, cousin, or friend. The funds cannot come from the disabled person’s own resources.
In another kind of special needs trust, the funds are the property of the disabled person and are usually the proceeds from an insurance settlement, lawsuit, or inheritance.
